Development of Ports and Harbours may involve construction of structures like breakwaters, jetties, reclamation bunds etc. and may also involve dredging to maintain depth of navigation. These projects are required to obtain Environment/ Coastal Regulation Zone (CRZ) clearance from the Ministry of Environment, Forests and Climate Change (MoEF&CC) and/or State Coastal Zone Management Authority (CZMA) as applicable as per the norms, As stipulated by MoEF&CC and CZMA, studies like Environment Impact Assessment (EIA) and Environment Management Plan (EMP) are undertaken as a part of the development of the projects. Based on the studies for the project, requisite mitigation measures to protect the environment are undertaken.

All Major Ports come under the administrative control of Ministry of Ports, Shipping & Waterways.  The construction of Port Infrastructure is done after conducting various scientific studies viz, Tranquility studies, study of movement of siltation, study on coastal erosion, literol drift, mathematical model studies, environment impact study, etc. and after obtaining statutory clearances viz environment clearance & Coastal Regulation Zone etc.

In order to ensure sustainable development of Ports, Maritime India Vision (MIV) 2030 was released which envisages development of Ports with safeguard for environment protection by adopting sustainable methodologies. The dredging guidelines for Major Ports has been released by the Ministry to ensure implementation of dredging projects with optimum utilization of the resources and re-use of dredged material for sustainable development of ports in the country.

3-Feb-2020: 2,130 Kerala islands now under CRZ cover

The new list was prepared by the National Centre for Earth Science Studies, Thiruvananthapuram, for the Kerala Coastal Zone Management Authority.

2,130 backwater islands of Kerala, including Maradu, have been brought under the Coastal Regulation Zone (CRZ) regime. The places included in the list have been witness to some major CRZ violations.

The move will lead to restrictions being imposed on development activities in these areas. No new development activity will be permitted in these islands in an area between the High Tide Line (HTL) and 50 meters towards the landward side, which is the CRZ area of these islands. This will limit the detrimental effect of human activities on the fragile coastal eco-system.

The Union Cabinet has approved the Coastal Regulation Zone (CRZ) Notification, 2018 which was last reviewed and issued in 2011, with periodic amendments to some clauses. The move comes in the backdrop of a series of representations received by the Ministry of Environment, Forest & Climate Change from various Coastal States/UTs, besides other stakeholders, for a comprehensive review of the provisions of the CRZ Notification, 2011, particularly related to the management and conservation of marine and coastal eco-systems, development in coastal areas, eco-tourism, livelihood option and sustainable development of coastal communities etc.

Benefits: The proposed CRZ Notification, 2018 will lead to enhanced activities in the coastal regions thereby promoting economic growth while also respecting the conservation principles of coastal regions. It will not only result in significant employment generation but also to better life and add value to the economy of India. The new notification is expected to rejuvenate the coastal areas while reducing their vulnerabilities.

Salient Features:

  1. Allowing FSI as per current norms in CRZ areas: As per CRZ, 2011 Notification, for CRZ-II (Urban) areas, Floor Space Index (FSI) or the Floor Area Ratio (FAR) had been frozen as per 1991 Development Control Regulation (DCR) levels. In the CRZ, 2018 Notification, it has been decided to de-freeze the same and permit FSI for construction projects, as prevailing on the date of the new Notification. This will enable redevelopment of these areas to meet the emerging needs.
  2. Densely populated rural areas to be afforded greater opportunity for development: For CRZ-III (Rural) areas, two separate categories have now been stipulated as below:
    1. CRZ-III A - These are densely populated rural areas with a population density of 2161 per square kilometre as per 2011 Census. Such areas shall have a No Development Zone (NDZ) of 50 meters from the HTL as against 200 meters from the High Tide Line stipulated in the CRZ Notification, 2011 since such areas have similar characteristics as urban areas.
    2. CRZ-III B - Rural areas with population density of below 2161 per square kilometre as per 2011 Census. Such areas shall continue to have an NDZ of 200 meters from the HTL.
  3. Tourism infrastructure for basic amenities to be promoted: Temporary tourism facilities such as shacks, toilet blocks, change rooms, drinking water facilities etc. have now been permitted in Beaches. Such temporary tourism facilities are also now permissible in the "No Development Zone" (NDZ) of the CRZ-III areas as per the Notification. However, a minimum distance of 10 m from HTL should be maintained for setting up of such facilities.
  4. CRZ Clearances streamlined: The procedure for CRZ clearances has been streamlined. Only such projects/activities, which are located in the CRZ-I (Ecologically Sensitive Areas) and CRZ IV (area covered between Low Tide Line and 12 Nautical Miles seaward) shall be dealt with for CRZ clearance by the Ministry of Environment, Forest and Climate Change. The powers for clearances with respect to CRZ-II and III have been delegated at the State level with necessary guidance.
  5. A No Development Zone (NDZ) of 20 meters has been stipulated for all Islands: For islands close to the main land coast and for all Backwater Islands in the main land, in wake of space limitations and unique geography of such regions, bringing uniformity in treatment of such regions, NDZ of 20 m has been stipulated.
  6. All Ecologically Sensitive Areas have been accorded special importance: Specific guidelines related to their conservation and management plans have been drawn up as a part of the CRZ Notification.
  7. Pollution abatement has been accorded special focus: In order to address pollution in Coastal areas treatment facilities have been made permissible activities in CRZ-I B area subject to necessary safeguards.
  8. Defence and strategic projects have been accorded necessary dispensation.

Background: With the objective of conservation and protection of the coastal environment, Ministry of Environment and Forest and Climate Change notified the Coastal Regulation Zone Notification in 1991, which was subsequently revised in 2011. The notification was amended from time to time based on representations received.

A need was felt overtime to undertake a comprehensive revision of the notification on the basis of number of representations from various Coastal States/UTs, besides other stakeholders particularly related to the management and conservation of marine and coastal eco-systems, development in coastal areas, eco-tourism, livelihood options and sustainable development of coastal communities etc. Therefore, the Ministry of Environment, Forest & Climate Change constituted a Committee in June 2014 under the Chairmanship of Dr. Shailesh Nayak (Secretary, Ministry of Earth Sciences) to examine the various issues and concerns of Coastal States/UTs and other stakeholders for recommending appropriate changes in the CRZ Notification, 2011.

The Shailesh Nayak Committee held wide ranging consultations with State Governments and other stakeholders and submitted its recommendations in 2015. The recommendations were further examined in consultation with Members of Parliament of Coastal States and Union Territories besides other concerned Ministries of Government of India. A draft notification was issued in April, 2018 for inviting comments from public at large.

A number of suggestions and comments were received by the Government and based on overall imperative of sustainable development of Coastal areas and need for conserving the Coastal environment, Government has approved the Coastal Regulation Zone Notification 2018 which is expected to go a long way in meeting the aspirations of Coastal communities besides ensuring welfare of poor and vulnerable populations.

The changes brought about in the CRZ Notification will further add to creating additional opportunities for affordable housing. This will benefit not only the housing sector but the people at large looking for shelter. The Notification is so designed that it balances the needs in such a way that both are fulfilled. Tourism has been one of the greatest creators of livelihood and jobs. The new Notification will boost tourism in terms of more activities, more infrastructure and more opportunities and will certainly go a long way in creating employment opportunities in various aspects of tourism. This will also give boost to people, desirous of seeing and enjoying the beauty of the mighty seas.

The Ministry of Environment, Forest and Climate Change (MoEF&CC) has framed a new draft Coastal Regulation Zone (CRZ) Notification, 2018.   The draft notification has been uploaded on the Ministry’s website on April 18, 2018.  Comments have been sought from the public within 60 days of the uploading of the draft Notification

The salient features of the draft CRZ Notification, 2018 and changes with respect to CRZ Notification, 2011, are as under:-

  1. The High Tide Line (HTL) has been demarcated by the National Centre for Sustainable Coastal Management (NCSCM) and shall be reckoned as a universal standard for the HTL for all regulatory purposes under the CRZ Notification, 2018.
  2. Hazard line mapping has also been carried out by Survey of India. The Hazard Line has, however, been delinked from the CRZ regulatory regime and shall be used only as a tool for Disaster Management and planning of adaptive and mitigation measures.
  3. CRZ limits on land along the tidal influenced water bodies has been proposed to be reduced from 100 meters or the width of the creek, whichever is less, to 50 meters or the width of the creek, whichever is less.
  4. A No Development Zone (NDZ) of 20 meters has been proposed to be stipulated for all Islands close to the main land coast and for all Backwater Islands in the main land.
  5. For CRZ-III areas, two separate categories have been proposed viz.:
    1. CRZ-III A – Densely populated rural areas with a population density of 2161 per square kilometre as per 2011 Census.  Such areas shall have an NDZ of 50 meters from the HTL as against 200 meters from the HTL stipulated in the CRZ Notification, 2011.

Wherever there is a National or State Level Highway passing through the NDZ in CRZ-III areas, temporary tourism facilities have been proposed to be taken up on the seaward site of the roads.  On the landward side of such roads in the NDZ, Resorts/Hotels and other tourism facilities have also been proposed to be permitted subject to the extant regulations of the concerned State.
  10. Regulated limestone mining is proposed to be permitted, subject to strict Environmental safeguards, in areas adequately above the height of HTL, based on recommendations of reputed National Institutes in the Mining field.

The relaxations/amendment proposed in the CRZ Notification, 2018 shall, however, come into force only after the respective Coastal Zone Management Programme (CZMP) framed to the CRZ Notification, 2011 have been revised/updated by the States/UTs, as per the provisions of the CRZ, 2018 Notification and approved by the Ministry of Environment, Forest & Climate Change.

The Ministry had constituted a Committee under the Chairmanship of Dr. Shailesh Nayak to examine the various issues and concerns of Coastal States/UTs and various other stakeholders and to recommend appropriate changes in the CRZ Notification, 2011.  The report submitted by Dr. Shailesh Nayak has been examined in the Ministry and consultations have been held with various stakeholders in this regard.

8-Mar-2017: Environment Minister launches Web Portal for obtaining CRZ Clearances

The Minister of State (Independent Charge) of Environment, Forest and Climate Change, Anil Madhav Dave, launched the web portal for obtaining Coastal Regulation Zone clearances.

The Portal is a web-based system for obtaining clearances required from the Ministry under the “Coastal Regulation Zone” (CRZ) by the Project proponents.  The system will enable the Project proponents and the concerned State/Union Territory bodies like the State Coastal Zone Management Authorities (SCZMAs) and Municipal/Town Planning agencies in tracking the status of their proposals.  The system is based on web architecture, similar to the existing systems in place for according environmental and forest clearances.

The Portal is a very user-friendly initiative, which enables submission of applications for CRZ clearance in a single-window interface and facilitates quick flow of information related to CRZ clearances.  The portal allocates a unique identity for each proposal for all future references.  It is accessible from any computer with internet facility.

The objectives of the web portal include – enhancing efficiency, transparency and accountability in the process of CRZ clearances; enhance responsiveness through workflows and availability of real-time information on the status of CRZ clearance proposals; ease of business and convenience of citizens in accessing information and services; standardized procedures and processes across Central and State levels.

There are other initiatives underway, like the notification of High Tide Line/Low Tide Line (HTL/LTL), ecologically sensitive areas falling under CRZ-1, hazard line etc.  All these steps are aimed at minimising discretions and enhancing accountability at all levels.
