9-Feb-2022: Assistance to nomadic tribes

Ministry of Social Justice and Empowerment has constituted a Board namely Development and Welfare Board for De-notified, Nomadic and Semi-Nomadic Communities (DWBDNCs) on 21.02.2019 for development and welfare of De-notified, Nomadic and Semi-Nomadic Communities. The Board has formulated a Scheme for Economic Empowerment for DNTs (SEED). The Ministry is also implementing schemes for pre and post matric scholarships to DNT students.

The SEED scheme has one of the objective to facilitate livelihood initiatives in community level to build up and strengthen small clusters of DNT/NT/SNT Communities institutions.

9-Feb-2022: Status of commission for Denotified and Nomadic Tribes

A National Commission for De-notified, Nomadic and Semi-Nomadic Tribes (NCDNT) was constituted by Government of India in February 2014, inter-alia, to prepare a state-wise list of castes belonging to De-notified, Nomadic and Semi-Nomadic Tribes. NCDNT submitted its report on 08.01.2018. The recommendations of NCDNT are given at Annexure-I.

As per the report, a total of 1262 communities have been identified as De-notified, Nomadic and Semi-Nomadic communities across the country, details of which may be seen at Annexure-II.

A committee has been set up by the NITI Aayog to study the De-Notified, Nomadic and Semi-Nomadic Communities. The committee has entrusted the task to Anthropological Survey of India which is currently under progress.

ANNEXURE-I

Main recommendations of National Commission De-Notified Nomadic and Semi-Nomadic Tribes (NCDNT).

  1. Setting up of a Permanent Commission at the Centre for Denotified, Nomadic and Semi-Nomadic Communities.
  2. Setting up of a Separate Department/Directorate for DNT/NT communities in States.
  3. Define NT and DNT. Uniformity in categorization of DNT/NT as SC/ST/OBCs across the States/UTs. Issue of single caste certificate. Sub-quota for DNT/NT/SNT within the quota of SC/ST/OBCs.
  4. Caste based Census in respect of DNT/NT/SNT communities in 2021 Census.
  5. Creating awareness among DNT/NT/SNT communities for their inclusion in mainstream.
  6. Sensitization of different government officials, law enforcing authorities and local bodies so that DNT/NT/SNT do not get differential treatment and benefits of mainstream schemes reach to DNT/NT/SNT communities.
  7. Schemes focusing DNT/NT/SNT communities for their health, education, housing, traditional art, traditional expertise.
  8. Livelihood of DNT/NT/SNT communities is largely dependent on the forests. Review "Indian Forest Act" and "Wild Life Protection Act" to give them their natural habitats.

29-Jan-2022: EPFO onboards Air India for social security coverage

EPFO onboards Air India for social security coverage to service the Social Security needs of their employees. Air India Ltd applied for voluntarily covered u/s 1(4) of the EPF & MP Act 1952 which has been allowed vide gazette notification dated 13.01.2022 w.e.f. 01-12-2021.

The social security benefits will be provided to around 7,453 employees for whom contributions have been filed by Air India with EPFO for the month of December 2021. These Employees of AIR INDIA now will be entitled to following benefits:

  1. The employees will receive extra 2% employer’s contributions in their Provident Fund Accounts at 12% of their wages. Earlier they were covered under the PF Act of 1925, where the contributions to the Provident Fund was at 10% by employer and 10% by employee,
  2. EPF Scheme 1952, EPS 1995 and EDLI 1976 will now be applicable to the employees.
  3. A guaranteed minimum pension of Rs 1,000/- will be available to employees and pensions to family and dependents in case of death of employee.
  4. An assured insurance benefit in case of death of member will be available in the range of minimum Rs.2.50 Lakh and maximum 7 Lakhs. No premium is charged to the EPFO covered employees for this benefit.

Since 1952-53, Air India and Indian Airlines were the two separate companies that were covered under PF Act 1925. In 2007, both the companies merged into one company- Air India Ltd.  Under the PF Act 1925, benefit of Provident Fund was available but there was no statutory pension scheme or insurance Scheme. The employees used to participate in self-contributory annuity-based pension scheme.  Based on the scheme parameters, the accumulations used to be paid to the employees. There was no minimum pension guarantee and no extra benefit in case of death of a member.

6-Dec-2021: Tribes Advisory Councils (TAC) have been constituted in all the ten states having Scheduled Areas

According to the provisions of Paragraph 4, under Article 244(1) of Fifth Schedule of the Constitution of India, the Tribes Advisory Councils (TAC) shall be established in each State having Scheduled Areas therein and, if the President so directs, also in any State having Scheduled Tribes but not Scheduled Areas therein.

Tribes Advisory Council shall consist of not more than 20 members of whom, as nearly as may be, three-fourths shall be representatives of Scheduled Tribes in State Legislative Assembly provided that if number of representatives of STs in State Assembly is less than number of seats in TAC to be filled by such representatives, remaining seats shall be filled by other members of those tribes.

Accordingly, Tribes Advisory Council (TAC) have been constituted in 10(Ten) states having Scheduled Areas therein namely Andhra Pradesh, Telangana, Chhattisgarh, Gujarat, Himachal Pradesh, Jharkhand, Madhya Pradesh, Maharashtra, Odisha and Rajasthan. Further, the States of West Bengal, Tamil Nadu and Uttarakhand not having any notified Scheduled Area also have Tribes Advisory Council constituted therein. Accordingly, there is no State (mandated to establish TAC), which have not constituted TAC.

The provision of the Paragraph 4, Part B, Sub-paragraph (2) of the Constitution provides that it shall be the duty of the Tribes Advisory Council to advise on such matters pertaining to the welfare and advancement of the Scheduled Tribes in the State as may be referred to them by the Governor.
